Who immigrates through the EB-5 program?
US immigration policy is relatively strict. In general, either a job offer or close family member is required to immigrate to the United States, unless the applicant wins the Green Card Lottery (chances <1%), has extraordinary or exceptional talents, or can claim to be a refugee. Even for those with a job offer, the waiting period can exceed 4-5 years.
EB-5 provides a relatively problem-free opportunity to immigrate to those with the means to do so. Such individuals may include retirees; those with nonimmigrant visas, such as H-1B or E-1/E-2, which may not provide a quick or any route to permanent residency; adult children of well-to-do businessmen who provide the EB-5 funds in the form of a gift to their children; real-estate rich individuals who either sell their real estate in their home country and use the proceeds to invest, or are able to take out a mortgage using the real estate as collateral and use the funds to invest; and those with children who will be “aging out” (turning 21) in the near future.
