Filing your Final Petition
Within 90 days of the two-year mark as a conditional permanent resident, you must file Form I-829. This petition will remove the conditions of permanent residency. You must present this petition along with evidence regarding the investments you have made. This will prove that, for the two-year term, the investment and enterprise were sustained. Furthermore, there should also be proof that 10 full-time jobs were created or are expected be created. These conditions may be slightly different if investment has been made with a regional center.
Once the petition and evidence have been submitted, the United States Citizenship and Immigration Services, or USCIS, will issue you a receipt for the I-829. This document is valid for one year and can be used as proof of permanent residence in the U.S. Should the process take more than a year, the immigrant and any applicable family members will need to get a stamp in their passports affirming this legal status.
